OEM/ODM & Private Label · Toys & Small Electronics

These Terms of Use apply to kingdafactory.com, operated by Shenzhen Jin Da Hui Plastic Products Co., Ltd. In these Terms, “KingDa,” “we,” “us” and “our” refer to that company. Please read these Terms before using our website or submitting a business inquiry.
This website introduces our products and manufacturing services to business customers, including brand owners, buyers, distributors and project partners. Areas presented may include toys, collectibles, small electronics, outdoor products and acrylic products, together with OEM, ODM, private-label, research and development, molding, assembly, packaging, dispatch and after-sales support.
The website supports business inquiries and project discussions. It does not provide an online checkout. Projects may involve affiliated factories; the scope of work and responsible contracting entity should be identified in the relevant project documents.
By using this website, you agree to these Terms to the extent they form an enforceable agreement under applicable law. If you do not agree, please stop using the website. When submitting an inquiry for a business, you must be authorized to provide its information and discuss the proposed project. An inquiry alone does not authorize you or us to bind that business to a purchase or manufacturing agreement.
Product photographs, descriptions, dimensions, materials, colors and other website information provide general reference for business discussions. Images may show samples, development concepts, customization examples or work produced for particular projects. Availability and customization options depend on the product and project.
Before ordering, confirm specifications, intended use, target market requirements, labeling, packaging and any testing or documentation needed with us in writing. A website image or general statement does not establish that a particular product is suitable or approved for every market. Any applicable certification or test report must be verified for the specific product and requirements.
Submitting a form, sending an email, requesting a quotation or receiving an automated acknowledgment does not by itself place or confirm an order. Website descriptions are invitations to discuss a project, rather than a complete offer to supply goods on fixed terms.
A quotation and a purchase order are different documents. Any quotation must be read with its stated scope, validity and conditions. An order becomes binding in accordance with the parties’ actual agreement and applicable law. Prices, minimum order quantities, payment arrangements, lead times, shipping responsibilities, inspection procedures and after-sales obligations must be confirmed for the particular project. These Terms do not set those commercial conditions.
Sample availability and whether a project qualifies for sampling or development depend on feasibility, materials, tooling and the proposed requirements. A sample request does not guarantee that a sample is available or that development will proceed.
Sample charges, development fees, tooling costs, delivery arrangements, revision scope and approval procedures should be agreed separately. Approval of a sample should be documented against the relevant specifications. Ownership of molds, tools, drawings, engineering work and newly developed intellectual property is determined by the applicable project agreement and law, not by submitting a website inquiry.
You retain your existing rights in drawings, artwork, logos, specifications, photographs and other materials you submit. Please provide only materials you own or are authorized to share and use for the proposed project. Do not upload unrelated personal information, unlawful content or files containing malicious software.
By submitting materials, you authorize us to review, reproduce and share them only as reasonably needed to evaluate your inquiry, prepare a proposal or carry out work you authorize, including with relevant personnel and project participants. This permission does not transfer ownership or authorize unrelated advertising, publication or commercialization. Any broader license or transfer must be agreed separately.
If your project involves unreleased designs, trade secrets or particularly sensitive business information, contact us to agree appropriate disclosure arrangements before sending detailed files. Where needed, a nondisclosure agreement should be agreed separately and should identify the information, permitted recipients and permitted uses.
Submitting an inquiry does not itself create a separate nondisclosure agreement. This does not remove confidentiality obligations arising under applicable law or an existing agreement. Any agreed confidentiality restrictions also apply to the handling of materials described above.
Website text, layout, graphics and other content are protected by applicable intellectual property laws. You may view and share links to the website and use reasonable excerpts for internal evaluation of a potential business relationship. Other reproduction or commercial use requires permission from the relevant rights holder, unless permitted by law.
Third-party brands, characters, logos and designs remain the property of their respective owners. Their appearance does not grant visitors a license or establish endorsement, partnership or availability for unrestricted reproduction. Any feedback, testimonial or project reference relates to its stated context and does not guarantee another project’s results.
Use the website lawfully and provide accurate information relevant to your inquiry. Do not impersonate others, submit fraudulent requests, infringe intellectual property, distribute malware, send abusive or unsolicited bulk messages, attempt unauthorized access, or interfere with website security or availability.
Automated access must not bypass access controls, collect personal information unlawfully or place an unreasonable load on the website. Ordinary search-engine indexing is permitted, subject to published crawler instructions and applicable law. We may take proportionate steps to restrict misuse and protect the website, while respecting applicable legal obligations.
The website may link to external websites or communication services. Those services are operated by their respective providers and may have their own terms and privacy notices. Please review them when using an external service. A link is provided for its relevant purpose and does not by itself endorse all content or services available at that destination. We do not control changes made to external websites.
Our Privacy Policy explains how personal information is handled in connection with this website and business inquiries, including how to contact us about your information. Please review it before submitting personal information or uploading files.
Providing contact details allows us to respond to the inquiry in accordance with that notice and applicable law. Acceptance of these Terms is not blanket consent to unrelated marketing or to processing that requires a separate consent.
We aim to keep website information useful and accurate, but information may become outdated or contain errors. Please verify information material to your purchasing decision with us. Access may be interrupted by maintenance, technical faults or circumstances outside our control.
To the extent permitted by applicable law, we do not warrant uninterrupted access or that general website information will meet every project requirement. Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable liability for fraud, willful misconduct, gross negligence or personal injury. Product warranties and contractual remedies are governed by the relevant agreement and applicable law.
Our company operates from Shenzhen, mainland China. These Terms do not displace applicable mandatory law or rights that cannot lawfully be waived. Governing law and any dispute procedure for a particular project may be addressed in its separately agreed contract; otherwise they are determined under applicable law.
If a separate agreement conflicts with these Terms on a matter it specifically addresses, that agreement governs that matter, subject to mandatory law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
We may update these Terms as the website or our business changes. The effective date identifies the current version. Changes do not automatically amend an existing order, nondisclosure agreement or other separate contract. Where applicable law requires additional notice or agreement, we will follow those requirements.
